		<description>I appreciate your podcast.  It is among the best LOST podcasts, if not the best.

Kate&#039;s trial was in California State Court.  Check the seal behind the bench.  Unless she murdered someone in California, she CANNOT be tried for murder.  Murder is a state matter and must be taken up by the state in which the murder occurred.

You mentioned some states having an aversion to the death penalty, etc.  It is not relevant as between states.  Extradition to foreign states is commonplace, death penalty or not.  Typically, if a defendant faces serious federal crimes and serious state crimes, an analysis will be made of the evidence and the cases will be brought in order of strongest case to weakest case.

In reality for Kate&#039;s case, she would be tried on the fleeing, bank robbery charges and any other federal crimes in federal court and the murder charges in state court.  Murder is always a state issue even if it is a federal officer.  If Iowa has a death penalty, it is likely she would be tried there first.</description>

Those would be the murder of the U.S. Marshall and the bank robbery. Another theory could be that the other municipalities decided to let the Feds try her since they were seeking a life sentence.
